THE INFLUENCE OF THE ETHNOCULTURAL SPACE ON THE DEVELOPMENT OF CUSTOMARY LAW IN THE TERRITORIES OF UKRAINE: THE ETHNOLOGICAL ASPECT


The topicality of the topic is of great importance for understanding the origin of Ukrainian customary law. The identification of traditions and customs that influenced legal norms will allow us to identify and analyze the customs and values of the Ukrainian people that influenced the development of customary law. Ethnocultural and ethnological aspects had a significant impact on the development of customary law. Ethnocultural space includes unique cultural traditions and various aspects of life of a certain ethnic group. These elements influence the formation of customary law, which is one of the main sources of law in many societies.

The study of customary law in Ukraine is of great importance for several reasons. First, the study of customary law allows a better understanding of the historical and cultural aspects of Ukrainian legal heritage. It helps establish the traditions, values and norms that have determined the life of the Ukrainian people for centuries. Secondly, the research has a practical application in the modern legal environment. For example, taking into account traditional customs and norms can contribute to the development of adaptive legal solutions that meet the needs of modern Ukrainian society. Thirdly, the study of customary law will help to find gaps in the cultural heritage of the Ukrainian people. This will help preserve the identity and self-awareness of the Ukrainian people.

The research methodology is based on the study of publications dealing with the genesis of customary law in Ukraine, the analysis of historical and modern data. It helps to understand what principles and values lay in the basic customary law; raising awareness about cultural heritage, which turned into legal norms. The results of the study show that the analysis of the genesis of customary law, namely the ethnological aspect, helps to reveal important aspects that influence the development of the modern legal system of Ukrainian society.
